Terms & Conditions

These terms and conditions of sale shall govern all transactions between ADR Avenir Private Limited (parent company of Macaone.online) and the Buyer relating to the Work(s) of Art from the online gallery/website www.macaone.online, and all other URLs forming part thereof (hereinafter referred to as “the Site”).

Macaone.online does not maintain physical possession of all Work(s) of Art, and its role shall be confined to that of a platform for the display and sale of the Work(s) of Art, from the Artist/Artisan to the Buyer.

The Site hosts a curated collection of Work(s) of Art online and is a platform for the sale and exhibition of, but not limited to, paintings, digital art, mixed media, photography, and sculptures. The Buyer, on viewing a specimen of the Work(s) of Art on the Site, may express interest in purchasing it through the Internet.

These terms and conditions shall apply to the sale of the Work(s) of Art of the Artist/Artisan to the Buyer through the Site. The Buyer must read, agree with, and accept all of the terms and conditions contained in this document.

Acceptance of Conditions

Before you use the Services, we require that you read and accept these Conditions. If you visit, shop, or otherwise participate in the Services on the Site, you accept these Conditions. If you choose not to accept these Conditions, you may not access or otherwise use the Site or Services.

All our policies, guidelines, and rules are hereby incorporated by reference into the Conditions.

Definitions

1. BUYER

“Buyer” means an individual above 18 years of age or a legal entity whose order for the Work(s) of Art is accepted by Macaone.online; or any individual who seeks to buy or directly/indirectly communicates with Macaone.online.

2. CONDITIONS

“Conditions” means these terms and conditions set out on the Site, including any special terms agreed in writing between the Buyer and Macaone.online.

3. ARTIST/ARTISAN

“Artist/Artisan” means an entity, individual, gallery, or organization interested in the sale of the Work(s) of Art through Macaone.online, including but not restricted to:

Individuals submitting their original work(s) of art.
Students enrolled in art-related programs.
Galleries promoting the works of varied Artists.
Owners lawfully possessing Work(s) of Art for resale.
Authorized groups/institutions/entities competent to sell art.

4. TRANSACTIONS

“Transactions” refer to online offers, acceptances, and sale contracts entered into by the Buyer, whether for professional or non-professional purposes.

5. WRITING

“Writing” includes email, postal letter, courier, or comparable means of communication.

6. WORK(S) OF ART / PRODUCTS

“Work(s) of Art/Products” means the artwork(s)/products (including instalments, parts, or reproductions) that an Artist/Artisan sells in accordance with these Conditions.

“Macaone.online” is owned and operated by:

8. SERVICES

“Services” means the services provided/to be provided by Macaone.online, which are subject to the Conditions, including curation, display, facilitation of sales, and consultancy.

Participation Requirements

Individual Registration: Use of the Site is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Minors (under 18 years) are not eligible unless represented by a parent/legal guardian.
Business Entity Registration: If you register as a business entity, you confirm that you are duly authorized to bind that entity.
Guest User: Guest users may browse/purchase but may face restrictions on listing, selling, or advanced features.

Macaone.online reserves the right to terminate accounts if misrepresentation or ineligibility is discovered.

Registration, Listing, and Selling

Artists must be registered users to list or sell on the Site.
By uploading work, Artists confirm ownership and originality. Macaone.online acts as a facilitator and is not liable for authenticity disputes, copyright infringements, or misrepresentation.
All images and artworks submitted may be used by Macaone.online for marketing and display purposes with due credit to the Artist.

Login ID, Password, and Security

Users are responsible for maintaining confidentiality of their login credentials and restricting access to their account. Any unauthorized use must be reported immediately to contact@macaone.online.

E-Platform for Communication

Macaone.online is an online platform that facilitates transactions. It is not a party to contracts between Buyer and Artist/Artisan. The sale contract is strictly bipartite.

Licence for Website Access

We grant you a limited, revocable license to access and use the Site for personal purposes. Prohibited uses include:

Copying, duplicating, or exploiting content for commercial purposes.
Using automated tools (robots, spiders) to extract data.
Reverse-engineering, creating derivative works, or interfering with the Site.

Shipping & Delivery

Express Shipping: 4–5 business days (chargeable).
Standard Shipping: 6–10 business days.
International Shipping: Up to 15 business days; customs duties borne by Buyer.

Timelines may vary in cases of Force Majeure, epidemics, or unforeseen delays.

Purchasing and Ownership Transfer

Buyers must be registered to purchase artworks.
Placing an order constitutes irrevocable acceptance once the artwork is shipped.
Risk transfers from the Artist to the Buyer upon shipment.
Authenticity guarantees are provided by the Artist; Macaone.online does not issue separate authenticity certificates.

Returns & Refunds

Returns are subject to refund policy norms.
Buyers must email photographs and details of damage.
Return shipping, insurance, and packaging costs are borne by the Buyer.
Refunds are processed via the original payment method.

Indemnity & Release

The Buyer agrees to indemnify and hold harmless ADR Avenir Pvt. Ltd., Macaone.online, its affiliates, officers, directors, and employees from any claims, damages, or disputes arising from breach of Conditions, misuse of the Site, or third-party claims.

Governing Law & Jurisdiction

These Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kamrup, Assam, India.
